Also, you should know that you are using outdated job loss estimates and that there is a difference between cutbacks due to drought, ESA for smelt, and ESA for salmon.

In your linked post, you state: "up to 90,000 jobs are threatened by the pumping cutbacks." The researchers who originally made that high estimate not only retracted and recalculated their estimates, but they followed-up and gave a much lower number.

You can get the updated article from David Zetland, who stated:
"In this revision [PDF] to the revision**** to their original study, Howitt et al. admit to using some flawed data in the first study and estimate 21,000 total job losses, with 16,000 from drought and 5,000 from pumping restrictions." http://aguanomics.com/2009/10/water-related-ag-job-losses-much-lower.html

Interesting thing is that you, in an attempt to clarify and correct Molly Peterson, fail to point out that the drought was the biggest reason for the cutbacks. Somewhere around 80% or more was due to the drought and its impact on salinity levels in the Delta. If they did not cut back pumping during drought, the projects would have pumped water too salty for farming or other uses. In addition, salinity restrictions are placed on the water rights for the projects. No doubt you were already aware of those salinity restrictions and salinity problems faced by San Joaquin Valley farmers. WEF has some info on the salty soil problem http://aquafornia.com/archives/13578 I hope your briefs address the drought and salinity levels.

Good luck on overturning the ESA on commerce clause grounds. You've got your work cut out for you.
